1. Acceptance of Terms

By accessing or using Casa Intelligence ("the Platform"), operated by Casa Intelligence Pty Ltd (ABN pending), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Definitions

"Platform" means the Casa Intelligence website (casaintelligence.com.au), Chrome Extension, API, and all related services. "User" means any individual or entity that accesses the Platform. "Subscriber" means a User with an active paid subscription. "Content" means all reports, data, analysis, and materials generated by the Platform.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. One person or entity per account — sharing credentials is prohibited.

4. Subscriptions and Payment

Paid subscriptions are billed monthly or annually as selected. Prices are in Australian Dollars (AUD) and exclude GST unless stated otherwise. Free trials last 14 days with full feature access. After the trial, your subscription will begin unless you cancel. Refunds are available within 7 days of initial purchase for annual plans. Monthly plans can be cancelled at any time effective at the end of the current billing period.

5. Service Description

Casa Intelligence provides property intelligence services including feasibility analysis, planning reports, development scores, and DA search capabilities for South East Queensland. The Platform uses automated systems including artificial intelligence to generate analysis. It serves property professionals including town planners, buyer's agents, and real estate agents through subscription plans, and the general public through one-off services.

6. Acceptable Use

You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to any part of the Platform; use automated systems to access the Platform beyond the provided API; resell, redistribute, or sublicense Platform content without written permission; use the Platform to generate misleading or fraudulent property representations; exceed your plan's usage limits through any means.

7. Intellectual Property

All Platform content, including but not limited to software, algorithms, reports, data compilations, and visual designs, is owned by Casa Intelligence Pty Ltd or its licensors. Subscribers receive a limited, non-exclusive license to use generated reports for their professional purposes. White-label reports may be presented under the subscriber's branding as permitted by their plan tier.

8. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. Property data is sourced from government databases, public records, and proprietary analysis. We do not guarantee the completeness or accuracy of third-party data sources.

9. Automated Content Disclaimer

Reports and analysis generated by the Platform use automated systems, including artificial intelligence, and should be treated as decision-support tools, not definitive professional advice. Platform-generated content may contain errors or omissions. Users should independently verify critical information before making property, planning, or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Casa Intelligence Pty Ltd's total liability for any claim arising from these Terms or the Platform is limited to the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Casa Intelligence Pty Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to access the Platform ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or Platform notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
