Terms of Service

1. Acceptance of Terms

By accessing or using Casa Intelligence ("the Platform"), operated by Casa Intelligence Pty Ltd (ABN 41 695 129 465), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Definitions

"Platform" means the Casa Intelligence website (casaintelligence.com.au), API, and all related services. "User" means any individual or entity that accesses the Platform. "Agency Account" means a monthly-invoiced trade account held by a real estate agency under the Agency Account Terms. "Content" means all reports, data, analysis, and materials generated by the Platform.

3. Accounts

The Platform does not require an account. Reports are ordered per report and delivered by email to the address given at checkout; the report is viewed at the link in that email. A real estate agency may hold an Agency Account, which is opened by application, ordered on by a link we issue to the agency, and governed by the Agency Account Terms. Every order placed on an Agency Account is an order by the agency and is payable by the agency.

4. Payment

One-off services, such as the Preliminary Planning Report and the DA Project, are charged at the price displayed at checkout and paid by card before work starts. Reports ordered on an Agency Account are invoiced once a month for the reports delivered in that month, on 14-day terms, as set out in the Agency Account Terms. There are no subscriptions. Prices are in Australian Dollars (AUD) and include GST unless stated otherwise. Refunds are handled in accordance with Australian Consumer Law; where we cannot cover a site we say so within one business day and the report is not charged.

5. Service Description

Casa Intelligence provides property and planning intelligence for Australian addresses. Its core services are the Preliminary Planning Report (a one-off intelligence report on a site's approval likelihood, constraints, comparable DAs, required disciplines, and charges) and the DA Project (in which our town planner prepares and reviews development application documents and lodges them with council on your instruction; consultant and council fees are billed separately). The Platform uses automated systems, including artificial intelligence, to support this analysis. Reports are decision-support tools and do not constitute legal advice or a guarantee of development approval.

6. Acceptable Use

You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to any part of the Platform; use automated systems to access the Platform beyond the provided API; resell, redistribute, or sublicense Platform content without written permission; use the Platform to generate misleading or fraudulent property representations; exceed your plan's usage limits through any means.

7. Intellectual Property

All Platform content, including but not limited to software, algorithms, reports, data compilations, and visual designs, is owned by Casa Intelligence Pty Ltd or its licensors. Subscribers receive a limited, non-exclusive license to use generated reports for their professional purposes. White-label reports may be presented under the subscriber's branding as permitted by their plan tier.

8. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. Property data is sourced from government databases, public records, and proprietary analysis. We do not guarantee the completeness or accuracy of third-party data sources.

9. Automated Content Disclaimer

Reports and analysis generated by the Platform use automated systems, including artificial intelligence, and should be treated as decision-support tools, not definitive professional advice. Platform-generated content may contain errors or omissions. Users should independently verify critical information before making property, planning, or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Casa Intelligence Pty Ltd's total liability for any claim arising from these Terms or the Platform is limited to the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Casa Intelligence Pty Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to access the Platform ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or Platform notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
